Terms of service

These Terms of Service ("Terms") are the rules for using www.exclusivelykristen.com (the "Site") and buying from us. The Site is run by Exclusively Kristen, LLC, an Ohio limited liability company located at 34194 Aurora Rd, Solon, Ohio 44139, United States ("Exclusively Kristen," "we," "us" or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Using the Site

You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. You agree to use the Site only for lawful purposes and to give us accurate information. You may not misuse the Site, including by trying to gain unauthorized access, interfering with how it works, using automated tools to copy its content, or placing orders you do not intend to pay for.

Products, colors and sizing

We try to describe and photograph our products as accurately as we can. Colors may look different on your screen, and small differences between pieces can occur. Our size guide, bra size tool, size charts and Personal Fit Check recommendations are guides to help you choose a size. They are not a guarantee of fit, because bodies, preferences and fabrics vary. Product availability can change without notice, and we may limit quantities.

Prices and payment

All prices are in U.S. dollars unless the Site says otherwise. We may change prices at any time, but a change will not affect an order we have already accepted. We collect sales tax only on orders shipped within the United States, where required. Payment is processed securely by Shopify and our payment providers when you place your order, and you agree to pay the total shown at checkout, including any shipping charges. Discount codes and promotions are subject to the terms shown with them, and may not be combined unless we say so.

Orders

Your order confirmation email means we received your order. It is not our acceptance of it. We accept your order when we ship it. We may cancel or refuse any order, for example because an item is out of stock, a price or product description contains an error, or we suspect fraud. If we cancel an order you have already paid for, we will refund you in full.

Shipping, duties and delivery

We ship worldwide from the United States. Shipping rates, delivery times and free shipping thresholds are set out in our shipping policy. Customs duties, import taxes and fees charged by the destination country are the buyer's responsibility. They are not included in your order total and we do not collect them. Please check that your shipping address is complete and correct before you pay, because we cannot guarantee delivery to an incorrect or incomplete address. Risk of loss passes to you when the carrier delivers your order.

Returns, exchanges and refunds

Returns and exchanges are governed by our return policy, which is part of these Terms. Items marked final sale cannot be returned or exchanged. Nothing in these Terms limits any right of withdrawal or other right you have under consumer protection laws that apply where you live.

Our content and your license to use it

The Site and everything on it, including photos, text, designs, logos, trademarks and our size guide and bra size tool, belong to Exclusively Kristen, LLC or our licensors. We give you a limited, non-exclusive, revocable license to view the Site and use its content for your own personal, non-commercial use. You may not copy, reproduce, modify, distribute or use our content for any commercial purpose without our written permission.

Reviews and content you submit

If you submit a review, photo, message or other content, you confirm it is yours, it is truthful, and it does not break any law or anyone else's rights. You give us a non-exclusive, royalty-free, worldwide license to use, display and reproduce it on the Site and in our marketing, and you keep ownership of it. We may remove content that is unlawful, misleading, abusive or off topic.

The Site runs on Shopify and uses other services, such as payment providers, shipping carriers, our returns portal and our review provider. The Site may also link to other websites. These services and sites have their own terms and privacy practices, and we are not responsible for them.

Privacy

Our privacy policy explains how we collect and use your information, and is part of these Terms.

Disclaimers

To the fullest extent the law allows, the Site and our products are provided "as is" and "as available," and we make no promises that the Site will always be available, error-free or free of harmful components. This does not limit any warranty or right you have under law that cannot be waived.

Limitation of liability

To the fullest extent the law allows, Exclusively Kristen, LLC and its owners, employees and service providers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your use of the Site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some places do not allow these limits, so they may not apply to you.

Indemnity

You agree to cover losses and reasonable costs we suffer because you broke these Terms or misused the Site, to the extent the law allows.

Governing law and disputes

These Terms, and any dispute arising from them or from your use of the Site or our products, are governed by the laws of the State of Ohio, United States, without regard to its conflict of law rules. You and we agree that the state and federal courts located in Cuyahoga County, Ohio have exclusive jurisdiction over any such dispute and that venue is proper in those courts. Nothing in this section limits any consumer rights you have under the mandatory laws of the place where you live, including the right to bring a claim in your local courts where the law gives you that right.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. If you keep using the Site after a change, you accept the updated Terms. Orders are governed by the Terms in effect when you placed them.

General

If any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a right right away, we have not given it up. These Terms, together with our shipping policy, return policy and privacy policy, are the entire agreement between you and us about the Site.
